Prayer: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, to direct the respondents 1 to 4 to remove the encroachment made by the fifth respondent, his men or agents by constructing at Odai at S.No.69/1 at Vannaampaaraipatti Village, near Meenatchipuram Village, Melur Taluk.

ORDER

Heard the learned counsel for the petitioner and the learned Special Government Pleader for R1 & R2. Issuance of notice to the fifth respondent is dispensed with.

2. The petitioner alleges that in Survey No.69/1 at Vannnaaampaaraipatti Village, illegal construction had come up.

3. The learned Special Government Pleader confirms that Survey No. 69/1 has been classified as "Oodai". Any construction in Oodai is 2/4

impermissible. We direct the third respondent to issue notices to the encroachers and have the same removed by adhering to due process of law. The entire exercise shall be completed within a period of 5 months.
