PRAYER:- Pleased to order to enlarge the petitioner/Accused on bail in connection with the case in S.C.No.172/2023 on the file of the Fast Track Mahila Court, Sivagangai.
ORDER : The Court Made the following order :- The petitioner, who is facing trial for the offence punishable under Sections 380, 457 and 302 IPC in S.C.No.172 of 2023 on the file of the Fast Track Mahila Court, Sivagangai in Crime No.92 of 2019 , seeks bail. 2.The case of the prosecution is that the petitioner was implicated in Crime 1/3
No.92 of 2019 on the file of the respondent Police and after completion of investigation, the respondent Police filed the charge sheet before the trial Court and the same was taken on file in S.C.No.172 of 2023. The petitioner has not appeared for hearing before the trial Court, hence, the trial Court has issued Non-Bailable Warrant against him, pursuant to which, he was arrested and remanded to judicial custody on 23.06.2023.
3.The learned counsel appearing for the petitioner would submit that the petitioner is ready to co-operate with the trial and the petitioner is in judicial custody from 23.06.2023. Hence, he prays for grant of bail to the petitioner.
4. The learned Additional Public Prosecutor appearing for the respondent Police would submit that 13 previous cases are pending against the petitioner. Hence, he vehemently opposed for grant of bail to the petitioner.
5. Considering the facts and circumstances of the case and the previous antecedent of the petitioner, this Court is not inclined to grant bail to the petitioner.
