Respondents PRAYER: The Suo Moto Habeas Corpus Petition is initiated under Article 226 of the Constitution of India, as per the order of the Division Bench, dated 29.06.2017 based on the Letter dated 15/06/2017 of Pradeep, aged 31/2017 S/o.Pitchai Muthu, praying to secure and produce his wife and daughter viz., Lavanya (age not known) wife of Pratheep, and Santhasoroubini, daughter of Pratheep, before this Court and handover them to his custody. ORDER

(Order of this Court was made by. M.M.SUNDRESH, J.) This petition has been numbered Suo Moto by the Registry in pursuance to the directions of the Hon'ble the Chief Justice. 2.In pursuance to the order dated 29.06.2017, mention was made by the learned Additional Public Prosecutor today stating that the detenue has been secured.

3. We made enquiry with the detenue, who is present before this Court along with her girl child by name Santhasoroubini. 4.The learned Additional Public Prosecutor would submit that investigation would reveal that the author of the petitioner namely, the husband of the detenue Prateep has suppressed material facts and enquiry reveals that he has married the sister of the detenue. Aggrieved over the same, the detenue left the matrimonial home along with her girl child allegedly with some other third party.

5. When a query was put to the detenue, she replied that she went out on her own and voluntarily along with the girl child. 6.Having satisfied that there is no illegal detention, we hereby dismiss this petition.
