O R D E R

This Criminal Original Petition is filed for directing the respondent police not to harass the petitioner and his family members under the guise of enquiry.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Criminal side) appearing for the respondent.

3.The learned counsel appearing for the petitioner submitted that the petitioner is the only breadwinner of his family and that the respondent police came to the petitioner's house on 15.06.2017 and asked him to come to the police station. It is further stated that the respondent police without even replying the petitioner, who asked the police about the reason for his presence in the police station forcibly took him to the police station. It was further stated that he has been harassed under the guise of enquiry. The counsel for the petitioner states that he is innocent and that he is being threatened by the police. 4.The learned Government Advocate, submitted that the petitioner is involved in a theft case and that therefore in connection with the crime alleged to have been committed by the petitioner he was asked to attend the enquiry. It is further submitted that there was no harassment by the police at any point of time under the guise of enquiry.

5.Recording the statement of the learned Government Advocate, this Criminal Original Petition is closed with a observation that the petitioner can be asked to attend the enquiry only after issuing summons by prescribing date and time and in the manner known to law.
