O R D E R

This Criminal Miscellaneous Petition is filed to relax the condition imposed on the petitioner in Crl.MP(MD) No.10366 of 2023 in Crl.A(MD) No.574 of 2023, dated 11.01.2024, in and by which, the petitioner was directed to appear before the trial Court on all first working day of every week at 10.30 a.m., until further orders. 2.The learned counsel appearing for the petitioner/appellant submits that the petitioner is complying with the condition regularly from 05.02.2024. 3.The learned Government Advocate appearing for the respondent seeks a short accommodation to ascertain as to whether this petitioner is complying with 1/3

the condition regularly or not.

4.It appears that the petitioner was granted with suspension of sentence by this Court on 11.01.2024 with a condition to report before the trial Court on the first working day of every week. According to the petitioner, he has complied with the condition from 05.02.2024. Believing the statement made by the learned counsel for the petitioner that he is complying with the condition regularly from 05.02.2024, the condition imposed on the petitioner in Crl.MP(MD) No.10366 of 2023 in Crl.A(MD) No.574 of 2023 is modified to the effect that the petitioner shall report before the trial Court on the first working day of every English Calender month at 10.30 a.m., till the disposal of the appeal. It is made clear that in the event, if it is found to be false, the respondent is at liberty to move an application to cancel the suspension of sentence.
