Heard both sides.

2. We are not satisfied that there are encroachments in the water body. It appears that there is a private dispute between the petitioner on the one hand and the fourth respondent on the other. The petitioner has to work out his rights only before the jurisdictional civil Court.

3. With the aforesaid liberty to the writ petitioner, this writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
