PRAYER: Petition is filed under Section 482 of the Criminal Procedure Code, to issue a direction, directing the learned Judicial Magistrate, Eranial, to expedite the trial pending in S.T.C.No.1761 of 2006, within the time stipulated by this Court. This Criminal Original Petition is filed under Section 482 of the Criminal Procedure Code, to direct the Judicial Magistrate, Eranial to expedite the trial pending in S.T.C.No.1761 of 2006, within a time frame.

2. Heard Mr.P.Banuprasath, learned counsel appearing for the petitioners and Mr.K.Anbarasan, learned Government Advocate (Crl.Side) appearing for the respondent and perused the records. 3.The learned counsel for the petitioners submitted that though the petitioners are accused Nos.1 to 4 in a crime, which was taken on file as STC.No.1761 of 2006 for the alleged offences punishable under Sections 147, 341 and 323 of IPC., on the file of the learned Judicial Magistrate, Eranial, Kanyakumari District, there was no further progress in the trial.

Having regard to the fact that the petitioners summoned all the witnesses and only few witnesses have to be examined, the trial is unnecessarily dragged on and hence, this Court is of the view that specific direction to the Trial Court for expedite the trial is necessary in this case. Hence, this Court directs the learned Judicial Magistrate, Eranial, Kanyakumari District, to complete the trial and dispose of STC.No.1761 of 2006, within a period of four months from the date of receipt of the copy of this order.

5. With the above direction, this Criminal Original Petition is disposed of.
