O R D E R

The present Petition has been filed by the accused No.5 in S.C.No.165 of 2026, on the file of the 6th Additional District Judge, Madurai seeking to quash the charge-sheet, wherein, the Petitioner is alleged to have committed the offence under Sections 191(2), 126(2),296(b),115(2),109(1), 351(3) and 118(2) of BNSS,2023. 2.A perusal of the charge-sheet reveals that the Petitioner along with others is said to have attacked the defacto complainant and caused skull injuries.

3.According to the learned counsel for the Petitioner, she was not present in the scene of occurrence and no recovery has been made from the accused.

4.Per contra,the learned Additional Public Prosecutor appearing for the first respondent-Police would submit that prima facie case has been made out as against the Petitioner and the submissions made by the learned counsel for the Petitioner is the subject matter of trial.

5.Heard the learned counsel appearing on either side and 2/5

perused the materials placed before this court. 6.Perusal of the charge sheet reveals that prima facie case has been made out as against the Petitioner and no legal ground is made out to quash the charge sheet filed against the Petitioner. However, the trial Court shall dispose of the criminal proceedings without being influenced by any of the observations made by this Court.

7.Considering the above said facts, the Criminal Original Petition is disposed of with the above direction. However, the presence of the petitioner is dispensed with during trial, unless specific orders are passed by the trial Court for her appearance.
