This Criminal Original Petition is filed under Section 482 of the Criminal Procedure Code, to direct the learned Additional District Munsif Cum Judicial Magistrate, Manamadurai to expedite and conclude the trial in C.C.No.98 of 2013.
2. Heard Mr.V.Sasikumar, learned counsel appearing for the petitioner and Mr.K.Anbarasan, learned Government Advocate (Crl.Side) appearing for the respondents and perused the records.
3. The learned counsel for the petitioner submitted that based on the complaint received from one Vasanthi as against her husband one V.R.Madhavan, a case was registered in Crime No.184 of 2013, for the offences punishable under Sections 498(A), 506(i) of IPC., and Section 4 of Tamil Nadu Prohibition of Women Harassment Act, on the file of the respondent police.
4. From the complaint, it appears that the petitioner is illicitly living with the said V.R.Madhavan. On account of that the wife of the said V.R.Madhavan, has given a complaint against the petitioner. not involved in any offence and that the allegation is only against the husband of the defacto complainant.
5.The petitioner has earlier filed a petition to quash the criminal proceedings and the same was dismissed by this Court on 20.03.2017 in Crl.O.P.(MD).No.3009 of 2017. Therefore, the submission of the learned counsel for the petitioner that the petitioner is not involved in the alleged offence may not be right. However, having regard to the other circumstances of the case, this Court directs the learned Additional District Munsif Cum Judicial Magistrate, Manamadurai, to expedite the trial and dispose of C.C.No.98 of 2011 within a period of four months from the date of receipt of the copy of this order.
