ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.
2.It is seen from the submissions made that the defacto complainant is dealing with harvest machine business. He was lured by his business agent one Ramar, who knows many industrialists at Madurai that if he gives money today they will give double the amount and believing the words of the said Ramar, the defacto complainant gave Rs.20 Lakhs to one Karthikeyan, who is a friend of Ramar at Veemas Hotel, Opposite to Madurai Anna Bus Stand. After receiving the money, the said Karthikeyan told that he would bring Rs.40 Lakhs within 30 minutes. But he did not come back. Thereafter, the defacto complainant lodged a complaint on 26.12.2020 against Ramar and Karthikeyan. After knowing that the complaint has been registered against them, Ramar approached the defacto complainant and told that to make ready Rs.
5 lakhs and give it to Karthikeyan, he would return the total amount. On 28.12.2020, at about 2 pm, when the defacto complainant along with his relatives went to Veemas Hotel, Karthikeyan was available and he was in possession of Rs.12.50 Lakhs. When questioning about the balance amount, he informed that the balance amount is available with Ramar and https://hcservices.ecourts.gov.
CRL OP(MD). No.6056 of 2021 Murugan. On the same day at about 3.00 pm, the defacto complainant handed over Karthikeyan along with Rs.12.50 lakhs to the police station.
3.The learned counsel for the petitioner submitted that the petitioner is no way connected with this case and his name is not mentioned in the First Information Report. Therefore, he seeks Anticipatory Bail.
4.The learned Government Advocate(Crl.Side) submitted that the name of the accused had been wrongly given as Karthikeyan in the First Information Report. In fact, Pauldurai is the main accused in the case and he was already arrested in Cr.No.1617 of 2020. On enquiry, it is revealed that a sum of Rs.40,000/- is available with Murugan, who is the petitioner herein and involved in this case. 5.Taking note of the innovative way of cheating said to have been committed by the accused in this case and the fact that the amount involved is a huge amount and the entire amount is not recovered from the accused persons, this Court is not inclined to grant Anticipatory Bail to the petitioner and accordingly this Criminal Original Petition is dismissed.
