ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under sections 406 & 420 of IPC r/w Sections 3, 5, 21(1), 21(2), 21(3), 23, 25 of Banning of Unregulated Deposit Schemes 1/3
Act, 2019 and 5 of TN Protection of Interest of Depositors Act (In Financial Establishment), 1997, in Cr.No.328 of 2023 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the defacto complainant has deposited his amount in one Samrithi Cheettu Scheme under Iswaryam Chit Funds Private Limited and when he went to collect the amount, he found the office locked and he was cheated by the petitioner. Hence, the complaint.
3. The learned Counsel for the petitioner would submit that the petitioner did not involve in any of the offences as alleged by the prosecution. The petitioner is an innocent and she is falsely implicated in this case. The petitioner is ready to abide by any conditions to be imposed by this Court. He therefore prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police would submit that A1 is the husband of A3. A2 and A3 are the Managing Directors of aforesaid financial institution at Kumbakonam main branch and the accused cheated the public money for a sum of Rs.1,76,19,750/-, however, no amount has been recovered till date and therefore, he prays to dismiss this Criminal Original Petition.
5. Considering the facts and circumstances of this case and also the nature of 2/3
the allegations levelled against the petitioner which are serious in nature and the fact that the public money is involved in this case and the accused cheated the public money for a sum of Rs.1,76,19,750/-, but, no amount has been recovered till date, this court is not inclined to grant anticipatory bail to the petitioner and accordingly, this criminal original petition is dismissed.
