RESPONDENT/RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to enlarge the petitioner on bail suspending the sentence imposed by the Special Court for Exclusive Trail of Cases under POCSO Act,2012, Virudhunagar District at Srivilliputhur in Spl.SC.No.52/2020 by judgement dated 11/11/2022, pending the disposal of the main Criminal Appeal on the file of this Hon'ble Court. PRAYER IN CRL A(MD)No. 488 of 2021:

Pleased to call for the records in the judgment of the Special court for Exclusive Trial of cases Under Protection of Children from the Sexual Offences Act, 2012, Virudhunagar District at Srivilliputhur in Spl.S.C.No. 52 of 2020 by Judgment dated 11/11/2021 and set aside the same.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.S.RAMASAMY, Advocate for the petitioner and of M/S.M.AASHA, Government Advocate (Crimal Side) on behalf of the Respondent, the court made the following order:- This petition has been filed to suspend the sentence imposed on the appellant made in Judgment dated 11.11.2021 in Special S.C.No.52 of 2020 on the file of the Special Court for Exclusive trial of cases under POCSO Act Cases, Virudhunagar and enlarge the appellant on bail.

2. This is the second petition. This Court by an earlier order dated 30.11.2021, taking into consideration the seriousness of https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL MP(MD) No.5220 of 2022 offence committed by the appellant, dismissed the petition filed by the appellant to suspend the sentence.

3. Taking into consideration the fact that there is no change in facts and circumstances of the case and also taking into consideration the serious offence committed by the appellant, this Court is not inclined to allow the petition.
