ORDER
The Tahsildar, Vedasandur Taluk has filed an affidavit dated 20.08.2025. Paragraphs 4 and 5 of the affidavit are as follows : "4.It is submitted that the survey was scheduled 16.12.2024, 17.12.2024, 31.12.2024, 24.01.2025 and 31.01.2025 to survey the lands comprised in Survey Nos. 413/1 and 414/1. Since due to unavailability of Police officials and PWD officials and due to non removal of bushes, the survey could not be conducted on the above said dates. Finally, on 26.03.2025 in the presence of the Police officials, PWD officials, Village Administrative Officer and Revenue Officials, the survey was conducted and boundaries were shown to the PWD officials and the reports were called from the Revenue Inspector, Ayyalur Firka and the Firka Surveyor.
5.It is submitted that reports were submitted before this Respondent on 27.03.2025. As per the report, 3 persons namely Sivasubramanian, Balamurugan and Karuppasamy (the petitioner herein) have encroached the land in survey no. 413/1 to an extent of 0.01.84 hectares out of total extent 2.02.00 hectares by growing 9 coconut trees and 6 amla trees. There is no encroachments made in Survey No. 414/1 having an total extent of 0.99.50 hectares. The above said Survey Numbers were classified as "Government Poramboke-River" and they are
under the control of Public Works Department (WRD), Nanganjiyar Division, Palani. The Revenue Officials have conducted Survey and the encroachments were identified and the PWD officials have laid the boundary stone. The details of encroachers and the nature of the encroachment was duly informed by this respondent issuing Form-I notice to the Assistant Executive Engineer, PWD (WRO), Irrigation Section, Vedasandur on 29.03.2025. Upon the direction of this Hon'ble High Court abiding the conditions mentioned in the order, the Respondent conducted the Survey and identifies the encroachers and informed the PWD officials with directions to remove the said encroachment."
