Prayer in WP(MD).SR23628/ 2017 :

To issue a Writ of Certiorarified Mandamus to call for the records pusuant to the 1st respondent impugned order dated 14.12.2016 order in Appeal No.133 of 2016 quash the same and direct the 1st respondent to pass appropriate order on merits in the petitioner's pre-deposit waiver application on merits.

ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.J.JOHN, Advocate for the petitioner and the court made the following order:- This petition is filed to condone the delay of 359 days in representing the Writ Petition.

2. Heard the learned counsel for the petitioner.

3. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is allowed and the delay of 359 days is condoned on condition that the petitioner shall deposit a sum of Rs.500/- (Rupees Five Hundred only) before the Tamil Nadu Mediation and Conciliation Centre, attached to the Madurai Bench of Madras High Court, Madurai, within a period of one https://hcservices.ecourts.gov.in/hcservices/

week from the date of receipt of a copy of this order, failing which, this petition shall stand dismissed automatically without any further reference to this Court.

4. The amount deposited can be used for the purpose of infrastructure facilities for the Tamil Nadu Mediation and Conciliation Centre.
