ORDER : The Court Made the following order :- The petitioners apprehend arrest at the hands of the respondent police for the offences punishable under Sections 498 (A) and 406 I.P.C., seek anticipatory bail and FIR in this case is yet to be registered.
2.The de-facto complainant has given a matrimonial complaint against the petitioners. There is a child born through the marriage between the first petitioner and the de-facto complainant. The child is with the de-facto complainant. The marriage had taken place in the year 2010. Therefore, the first petitioner / husband undertakes to pay a sum of Rs.10,000/- (Rupees Ten Thousand Only) to the de-facto complainant towards her maintenance and that of the child. This will be only an interim arrangement till the orders are passed by the competent Court. The de-facto complainant is directed to furnish the bank details to the first petitioner. This would not prejudice the rights of either parties.
3.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.VI, Madurai, and executing https://hcservices.ecourts.gov.in/hcservices/
a seperate bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two common sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police as and when required for interrogation. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously. 4.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
