ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 420, 294(b) and 506(ii) of I.P.C in Crime No.204 of 2016 on the file of the respondent police, seek anticipatory bail. 2.Heard the learned counsel appearing for the petitioners and the learned Government Advocate(Crl. Side) appearing for the respondent/State.
3. The learned counsel for the petitioners submitted that the first petitioner is the father of the second and third petitioners herein and they did not commit any such offence as mentioned in the F.I.R. He further submitted that the first petitioner has filed a https://hcservices.ecourts.gov.in/hcservices/ civil suit in O.S.No.371 of 2016 on the file of the learned
Principal District Munsif, Tenkasi, against the defacto complainant and another person, praying for permanent injunction and the same is pending.
4. The learned Government Advocate(Crl. Side) submitted that the first petitioner contacted the defacto complainant and introduced himself as Chelladurai and the second and third petitioners are his son and daughter and he is running a rice mill in the name and style of Packiyavincy Rice Mill at Kallidaikurichi and the defacto complainant had given paddy to the petitioners herein and a sum of Rs.65,87,999/- is due from them. He further stated that on verification by the defacto complainant, it is seen that there is no such mill in the name and style of Packiyavincy Rice Mill at Kallidaikurichi and also the name of the first petitioner is not Chelladurai and investigation is pending.
5. Considering the overt act attributed against the petitioners in the F.I.R, this Court is not inclined to grant anticipatory bail to the petitioners, at this stage. Accordingly, this Criminal Original Petition is dismissed.
