Heard both sides.

2.The question of cancelling an entry made in the encumbrance register cannot arise. Relief can be given to the petitioner by registering the petition mentioned judgment and decree.

3.The petitioner is permitted to submit a proper application before the respondent for registering the petition mentioned judgment and decree. The question of invoking Section 23 of the Registration Act will not arise at all. As and when such an application is filed, it shall be accepted by the respondent and appropriate entry shall be made in the encumbrance register. 4.This writ petition is disposed of accordingly.
