ORDER

This Criminal Original Petition has been filed to direct the first respondent to conduct further investigation and file Additional charge sheet against the respondents 6 and 7 on the basis of order passed in Crl.M.P.No. 1716 of 2024 in C.C.No.1625 of 2022, dated 29.10.2024 on the file of the Judicial Magistrate Court No.I, Madurai.

According to the petitioner, he is the de facto complainant in this case and based on the complaint, a case in Crime No.23 of 2021 was registered and thereafter, the first respondent filed final report and the same was taken cognizance in C.C.No.1625 of 2022 and thereafter, an application in Crl.M.P.No.1716 of 2024 was filed and the learned Judicial Magistrate directed 2/5

the first respondent to conduct further investigation and file final report within three months through an order, dated 29.10.2024 but the said order has not been complied, therefore, the petitioner filed this petition.

3. The learned Government Advocate (Crl. Side) appearing for the first respondent would submit that the first respondent already completed the investigation and filed final report and the same was taken cognizance by the Trial Court in C.C.No.1625 of 2022. However, the petitioner filed a petition for further investigation due to the deletion of respondents 6 and 7 and thereby, the learned Judicial Magistrate has directed the first respondent to conduct further investigation and the same is pending, and they will complete the further investigation within 15 days.

Since the prayer of the petitioner is to direct the first respondent to complete the investigation and the first respondent also admitted the pending investigation and assured to complete the investigation within 15 days, recording the above said submission of the first respondent, this Court directs the first respondent to complete the further investigation and file appropriate 3/5

report before the learned Judicial Magistrate within 15 days from the date of this order.

5. With the above said observations, this Criminal Original Petition stands disposed of.
