Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondent to consider the petitioner's recent representation dated 25.02.2022 and issue patta to her regarding the punja landed property comprised in SR.No.387/2A to an extent of 1 acre 91 cent situated at Kongampatti Village, Melur Taluk, Madurai District within a period stipulated by this Court.

ORDER

This Writ Petition has been filed for a Mandamus seeking for a direction to the respondent to consider the petitioner's representation dated 25.02.2022 seeking for issuance of patta in her name for the property being Punja land comprised in SR.No.387/2A measuring an extent of 1 acre and 91 cents situated at Kongampatti Village, Melur Taluk, Madurai District within a time frame to be fixed by this Court.

2. The petitioner claims that she is the absolute owner of the aforementioned property. She has filed copies of documents to prove her ownership along with the Writ Petition. It is for the respondent to consider the same on merits and in accordance with law. The petitioner also claims that she is in possession and enjoyment of the aforementioned property ever since the purchase of the same. The petitioner has submitted a representation on 25.02.2022 with the respondent seeking for issuance of patta.

3. Heard Mr.E.Mohamed Abbas, learned counsel for the petitioner and Mr.B.Saravanan, learned Additional Government Pleader, who accepts notice on behalf of the respondent.

4. No prejudice would be caused to the respondent, if the petitioner's representation is considered on merits and in accordance with law, after affording a fair hearing to the petitioner and other rival claimants, if any, within a time frame to be fixed by this Court.

For the foregoing reasons, this Court directs the respondent to consider the petitioner's representation dated 25.02.2022 seeking for issuance of patta in respect of the property being Punja land comprised in SR.No.387/2A measuring an extent of 1 acre and 91 cents situated at Kongampatti Village, Melur Taluk, Madurai District and pass final orders on merits and in accordance with law, after affording a fair hearing to the petitioner and other rival claimants, if any, including granting them the right of personal hearing, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

6. With the aforesaid direction, this Writ Petition is disposed of. There shall be no order as to costs.
