Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the entire records relating to the impugned order passed by the 4th respondent in C1/00661/2021/va.ma, dated 31.03.2021 and quash the same and consequently directing the 4th respondent not to effect the recovery and reduce the salary of the petitioner.

O R D E R

The present Writ Petition has been filed by the unskilled employees working in Tuticorin Municipal Corporation challenging the show cause notice issued by the fourth respondent for revision of pay scale.

2. A perusal of the impugned order reveals that it is only a show cause notice and the authority so far has not taken any decision. 2/5

3. This Court is of the opinion that the writ petition would not lie as against the show cause notice. The petitioners are directed to file their objection if any, along with documents within a period of two weeks from the date of receipt of a copy of this order.

4. The objection shall be considered by the Municipal Corporation and a reasoned order shall be passed thereafter. Till such time, they shall not been any recovery.

5. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently connected Miscellaneous Petitions are closed.
