Respondents PRAYER : Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus to direct the the 2nd respondent herein to conduct survey and demarcate the property comprised in S.Nos.721, 722, 723, 724, 721/3, 721/4, 722/1B, 722/2, 696/17, 975/3A in Erichanatham Village, Sivakasi Taluk, Virudhunagar District.

ORDER
This writ petition has been filed for the issue of a writ of mandamus directing the respondents to act upon the representation made by the petitioner on 09.04.2021 and to conduct the survey and demarcate the subject property within the time limit fixed by this Court.
2.The case of the petitioner is that he is the absolute owner of the subject property by virtue of the registered sale deed dated 22.04.2019. The petitioner wanted to conduct a survey and to fix the boundary stones.
The petitioner, therefore, made a representation before the respondents. Since the same was not considered, the present writ petition has been filed before this Court seeking for appropriate directions.
3.Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents. 4.It is seen from the records that the second respondent had https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD)No.8822 of 2021 already issued notice to the petitioner and the third respondent and had fixed the date for the survey of the property. The said notice is available at Page No.26 of the typed set of papers. 5.In view of the above, there shall be a direction to the second respondent to issue a fresh notice to the petitioner and the third respondent and proceed further to conduct a survey and fix the boundaries in the subject property based on the title deeds of the parties. This process shall be completed by the second respondent within four weeks from the date of receipt of a copy of this order. 6.The petitioner is directed to make a fresh representation to the second respondent along with all the relevant documents and also a copy of this order.
7. This writ petition is disposed of with the above direction. No costs.
