The above petition has been filed seeking orders to restore the appeal, which was dismissed for non-prosecution on 24.07.2024.

2. Even today, there is no representation for the second respondent.

3. Heard the learned counsel appearing for the petitioner.

4. It is evident from the records that the petitioner's earlier petition in CMP (MD)No.3625 of 2026 to condone the delay in filing the restoration petition was allowed on cost.

5. Considering the reasons assigned and taking note of the submission made by the learned counsel appearing for the petitioner, this Court is inclined to set aside the order dated 24.07.2024. Accordingly, this petition is ordered and the Registry is directed to restore the appeal on file and post the same on 23.06.2026.
