This application is filed to condone the delay of 160 days in filing the revision.
2. Heard Mr.C.Vakeeswaran for the petitioner and Ms.Sivatharani representing Mr.H.Lakshmi Shankar for the respondent.
3. Though Ms.Sivatharani stoutly opposes the application for condonation of delay, a perusal of the affidavit shows that the petitioner, on account of old age (aged about 79 years) and sickness, was not in a position to contact the Counsel, who represented him before the Trial Court and obtain the copies. I find it sufficient cause. Hence, this petition is allowed and delay is condoned.
4. Registry is directed to number the revision, if it is otherwise in order and list the same for admission by printing the name of Mr.H.Lakshmi Shankar for the respondent.
