For Respondent : Mr.Kr.Bharathi Kannan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.283 of 2021 on the file of the respondent Police ORDER : The Court made the following order :- The petitioner/A2, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 406, 420 and 506(1) of IPC in Crime No.283 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that the de-facto complainant was doing manufacture of flour business. One Santhi approached the de-facto complainant stating that her husband/petitioner was working as a Conservative Inspector at Collector Office and he can make arrangements for loan from the Government. On her promise, the defacto complainant deposited and paid in cash for a sum of Rs.9,28,000/- to A1. After receipt of the amount, the petitioner has not arranged for any loan and when she demanded the money paid by the accused, he criminally intimidated her. Hence, the complaint.

CRL OP(MD). No.5989 of 2021 3.The learned counsel for the petitioner submitted that this petitioner has no way involved in the offence and he has been falsely implicated in this case. He further submitted that the alleged amount was given only to the first accused and not to the petitioner herein. Therefore, he seeks anticipatory bail to the petitioner.

4.The learned Government Advocate (Criminal side) for the respondent police strongly opposed this petition on the ground that the investigation is pending.

5.Considering the fact that a sum of Rs.9,28,000/- was said to have been cheated by the petitioner along with co-accused and the fact that the investigation is pending in this case, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, this petition is dismissed.
