Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents to pay pension and commutation of pension to the petitioner for his entire service period from 01.01.1986 to 31.05.2015 under TNSTCEPF Rules, with pension arrears from 01.06.2015 together with 16% interest per annum.

Heard the learned counsel on either side.

2. The petitioner was employed in Tamil Nadu State Transport Corporation (Kumbakonam) Limited as Conductor. He was charged with some delinquency and dismissed from service. He raised an Industrial Dispute. The matter has already seen two rounds of litigation. The matter was remanded. Questioning the award passed by the Labour Court after remand, the Management has filed https://hcservices.ecourts.gov.in/hcservices/

W.P.No.2419 of 2018 before the Principal Bench. It is still pending.

3. Therefore, it is for the petitioner to workout his remedy only in the said writ petition filed by the Management. However, the respondents are directed to pay provisional pension to the petitioner together with arrears. Such disbursement shall be made within a period of eight weeks from the date of receipt of a copy of this order.

4. This Writ Petition is disposed of as indicated above. No costs. Consequently, M.P. (MD). No. 1 of 2015 is closed.
