Respondents Prayer :- This Petition is filed Under Article 226 of the Constitution of India praying to issue a writ of Certiorari to call for the records pertaining to the G.O.Ms.No.262 dated 31.05.2020 issued by the 2nd respondent and quash the same in so far clause IV (v) permitting the restaurants to function dine-in facility with 50 percentage of seating capacity.
ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.T.Leninkumar, Advocate for the Petitioner and of Mr.Aayiram K Selvakumar, Additional Government Pleader for the respondents, this Court made the following order: (Order of the Court was made by M.SATHYANARAYANAN,J.) The status report, as directed by this Court, has been filed by the third respondent.
2. It is also brought to the notice of this Court by Mr.Aayiram K.Selvakumar, learned Additional Government Pleader, appearing for the official respondents that the lock down with some limited activities has been extended till 31.08.2020 and the Restaurants are permitted to function by strictly adhering to COVID-19 pandemic virus Standard Operating Procedure and therefore, the apprehension https://hcservices.ecourts.gov.in/hcservices/
expressed by the petitioner has been answered.
3. The learned Counsel appearing for the petitioner, in response to the said submission, would submit that it is difficult to enforce Standard Operating Procedure to control COVID-19 pandemic virus practically and hence, this Court is to interfere and pass appropriate orders.
4. With regard to abate the fast spread of COVID-19 pandemic virus, Standard Operating Procedure is already put in place by the State Government and it also includes maintenance of social distance etc., Therefore, no further orders are necessary in this Writ Petition.
