For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 02/2023 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/sole accused, who apprehend arrest at the hands of the respondent Police for the offences punishable under Section 7 of prevention of Corruption Act 1988(as amended in) and section 102 of Cr.P.C in Crime No.2 of 2023 on the file of the respondent Police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner herein was working as a bill clerk in Civil Supply Corporation in Ramanathapuram. Based on secret information the respondent police searched the spot and they recovered Rs.350/- from the petitioner. The petitioner explained that the above money was his self money. Thereafter on further search they found Rs.9600/- and the same was also recovered. The further allegation is that the petitioner herein used to collect Rs.30/- per bag from each farmer and when the petitioner's account was verified it was found that through g.pay and phone pay he has received a total sum of https://www.mhc.tn.gov.in/judis 1/2

3. Heard both side and perused the materials available on record including the First Information Report

4. It is seen that the petitioner is the sole accused. He was working as a seasonal bill clerk in the Civil Supplies Corporation. During investigation the respondent police recovered Rs.9600/- cash. That apart through his account he has received a sum of Rs.1,93,500/- from the farmers. He used to collecte Rs.30/- for one procuring one bag of paddy from the farmers, therefore custodial interrogation of the petitioner is very much required in this case, hence this court is not inclined to grant anticipatory bail to the petitioner.

5. Hence the petition stands dismissed.
