PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, praying to direct the 1st and 2nd respondent herein to direct the third respondent not to harass the petitioner and his family members on the guise of the enquiry, as per legal notice dated 06.06.2020 For Petitioner : Mr.S.Thangaraj For R-1 to R-3 : Mr.S.Chandrasekar Additional Public Prosecutor

O R D E R

This criminal original petition has been filed seeking a direction to direct the third respondent herein not to harass the petitioner and his family members under guise of the enquiry as requested in the legal notice dated 06.06.2020 given by the petitioner.

2.Today, when the matter came up for hearing, the learned Additional Public Prosecutor appearing for the respondents 1 to 3 would submit that based on the complaint given by the fourth respondent, enquiry was initiated in C.S.R.No.12518 of 2020 and thereafter, on 18.06.2020, the petitioner and the respondents 4 and 5 were appeared before the third respondent police for enquiry. In the enquiry, the petitioner made an undertaking that he will repay the advance amount which was received from the fourth respondent. The said undertaking given by the petitioner was recorded. Hence, in view of the same, the question of harassment of the third respondent does not arise.
