Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India, for the issuance of Writ of Mandamus, directing the 3rd respondent to submit his report to the 2nd respondent in pursuant to the proceedings of the 2nd respondent in Na.Ka.No.0432/2019/AA4 dated 05.02.2019 and consequently direct the respondents to sub divide and issue patta to the petitioner in respect of his plot bearing Plot No.99 in S.No.332/14A1A situated at Mandaiyur Village, Kulathur Taluk, Pudhukttai District. ORDER
This writ petition has been filed for the issue of writ of mandamus directing the third respondent to submit the report to the second respondent pursuant to the proceedings of the second respondent dated 05.02.2019 and for a consequent direction to the respondents to sub-divide the subject property and to issue patta in favour of the petitioner.
2. Heard Mr.R.Kavinprasath, learned counsel appearing on behalf of the petitioner and Mr.R.Sureshkumar, learned Government Advocate appearing on behalf of the respondents. 1/3
3. Taking into consideration the facts and circumstances of the case and also the fact that the second respondent has already started the process of sub-division of the property and had sought for the report of the third respondent, there shall be a direction to the third respondent to submit the report before the second respondent within a period of four weeks from the date of receipt of a copy of this order.
4. The second respondent, on receipt of the same, shall pass orders of its own merits and in accordance with law after affording opportunity to all concerned within a period of eight weeks thereafter.
5. The petitioner is directed to make a fresh representation to the second and third respondents along with a copy of this order.
6. This writ petition is disposed of with the above directions. No Costs.
