Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to call for the records relating to the impugned order in Na.Ka.No.2072/Aa1/2021 dated 10.12.2021 passed by the 3rd respondent and quash the same as Illegal and consequently cancel the 5th respondent registered sale deed No.1921 of 2000 dated 21.12.2000 on the file of the 4th respondent.

ORDER

When the matter was taken up for hearing, the learned counsel appearing for the fifth respondent pointed out that the petitioner and her son have already filed O.S.No.15 of 2022 on the file of the District Munsif Court, Thirumayam. When the petitioner has already filed a civil suit challenging the impugned order, the question of parallely mounting a challenge under Article 226 of the Constitution of India does not arise at all. The petitioner is at liberty to pursue her suit remedy.

2. With this liberty to the petitioner, the Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed. 13.06.2024 Index : Yes / No Internet : Yes/ No rmi 2/4
