PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondent to extend the emergency leave for a period of eight weeks to the petitioner for taking treatment and surgery for PAN SINUSITIS, under Rule 6 of the Tamil Nadu Suspension of Sentence Rules, 1982.

The petitioner seeks a writ of Mandamus directing the respondent to consider her representation for extension of medical leave. When the writ petition came up for hearing, it was stated that the authority passed an order rejecting the representation of the petitioner. Therefore, the petitioner wants to amend the prayer in the writ petition.

2. After some argument, the learned counsel for the petitioner would submit that she would make a fresh representation and seeks a direction to the authority to consider the said representation within a stipulated time.

3. Taking note of the fact that the petitioner is suffering from some illness, the writ petition is disposed of with the following directions :

1) The petitioner is permitted to make a fresh representation to the authorities seeking extension of leave.

2) The authorities are required to consider the said representation sympathetically and pass orders within a period of ten (10) days from the date of receipt of representation from the petitioner.
