PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents to extend the period for repayment of e-auction amount by the petitioner in respect of property in S.Nos.223/1 (old), 223/1B2, and 223/1B3 (new) to an extent of 6383.10 sq.,ft., Vallampudur Sethi village, Thanjavur Taluk, Thanjavur District by considering the petitioner's representation, dated 21.03.2024 within the period that may be stipulated by this Court.

ORDER

(Order of this Court was made by G.ARUL MURUGAN, J.) The Writ Petition is filed for a direction to the respondents to extend the period for re-payment of e-auction amount by the petitioner in respect of the property purchased by him in an auction conducted on 27.12.2023 by considering his representation, dated 21.03.2024. 2.After making a brief submissions on merits, when it was pointed out to the learned Counsel for the petitioner about the maintainability of the prayer, as already a communication, dated 04.03.2024 has been issued by the respondent Bank regarding forfeiting of the 25% of the amount already paid, the learned Counsel for the petitioner sought permission of this Court to withdraw the Writ Petition with liberty to seek necessary relief before the appropriate forum. The learned Counsel for the petitioner has also made an endorsement to that effect in the Court bundle. 2/4
