O R D E R

This Criminal Original petition is filed seeking a direction to the second respondent/Inspector of Police, Singampunari Police Station, Sivagangai District, not to harass the petitioners in the name of holding up an investigation.

2. Heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor appearing for the respondents.

3. The petitioners are father-in-law and wife respectively of one Manikandan who is involved in a criminal case. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Additional Public Prosecutor appearing for the respondents submitted that a criminal case was registered against

the said Manikandan. Pursuant to the complaint given against him, wherein it was stated that the said Manikandan had developed an extra marital affair with the minor girl and it is found that he was missing with the minor girl.

5. The learned counsel appearing for the petitioners stated that the petitioners are not involved in the crime and they would not associate having regard to the nature of crime alleged against the son-in-law of the first petitioner. It is further submitted that the petitioners are being harassed under the guise of enquiry.

6. Having regard to the facts narrated by the learned counsel for the petitioners and the submission of learned Additional Public Prosecutor for the respondents that an enquiry was conducted only in relation to the criminal case pending and this Court is of the view that the petitioners who are not involved in any criminal case need not be harassed. Even, if any enquiry is conducted and the presence of the petitioners is required for such enquiry, the same shall be done only after issuing summons prescribing date and time and in the manner known to law.

7. With the above observation, this Criminal Original Petition is closed.
