O R D E R

This Criminal Original Petition has been filed, seeking quashment of the FIR in Crime No.7 of 2022 on the file of the first responent Police as against the petitioner.

2. The case of the prosecution is that the petitioner approached the defacto complainant that he will arrange the Government Job to the defacto complainant. Believing the false promise made by the petitioner, the defacto complainant and others given totally Rs.31,50,000/- to the petitioner. Thereafter, the petitioner neither secured the job nor returned the money. Thereby, a complaint was given by the defacto complainant and challenging the same, the present petition has been filed. 2/5

The learned counsel for the petitioner would submit that more than 50% of the amount was settled to the defacto complainant and others and the petitioner is ready to settle the balance amount within a period of two weeks from today. On payment of entire amount to the defacto complainant and others, compromise memo will be filed before the first respondent.

4. The learned Additional Public Prosecutor would submit that on receipt of compromise memo filed by the petitioner and the defacto complainant and others, the first respondent will refer the matter as further action dropped.

5. In view of the submissions made by the counsels on either side, if any compromise memo is filed by the petitioner and the defacto complainant, the first respondent is directed to refer the case in Crime No.7 of 2022 as further action dropped, within a period of four weeks from the date of receipt of copy of this order. If there is no amicable settlement between the parties, the first respondent is at liberty to pass 3/5

appropriate orders.

6. With the above said direction, this Criminal Original Petition is disposed of. Consequenlty, connected Miscellaneous Petition is closed. 29.02.2024 NCC:Yes/No Index:Yes/No Internet:Yes/No Indu To:
