ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.1, in Crime No,81 of 2017 on the file of the respondent police, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 341, 294(b), 324 and 506(ii) r/w.109 of I.P.C and hence, seeks anticipatory bail.

2. This is the second Anticipatory Bail Application, earlier this Court granted Anticipatory Bail to the petitioner in Crl.O.P.(MD) No.6666 of 2017, dated 08.06.2017. Since, the petitioner was admitted in the rehabilitation centre, he was not able to produce the sureties and comply with the conditions imposed by this Court and hence the Anticipatory Bail granted by this Court was lapsed. Hence, he filed this second Anticipatory Bail Application.

3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent/State, who would submit that there is no disturbance from the petitioner at present.

4. Considering the fact that the petitioner was admitted in the rehabilitation centre and the police had no disturbance form the petitioner at present, this Court is inclined to grant Anticipatory Bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest https://hcservices.ecourts.gov.in/hcservices/

or on his appearance before the learned Judicial Magistrate No.V, Madurai and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with surety for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as on when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C., scrupulously. 5.The petitioner shall appear before the concerned Magistrate within a period of 15 days form the date on which the order copy made ready, failing which, the petition for Anticipatory bail stands dismissed.
