This Criminal Original petition is filed to call for the records pertaining to the case in Crime No.178 of 2013 on the file of the first respondent police and quash the same.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal side) appearing for the first respondent.

3. The learned Government (Crl. Side) appearing for the first respondent on instructions would submit that the final report has already been filed on 05.09.2016, before the concerned Court and the same is yet to be taken on file.

4. The learned counsel appearing for the petitioner seeks permission of this Court to withdraw this petition with liberty to challenge the charge sheet as he has got valid grounds and he has also made an endorsement to that effect.

5. Recording the same, the Criminal Original Petition is dismissed as withdrawn. However, the petitioner is at liberty to challenge the charge sheet, which is already filed. Consequently, connected Miscellaneous Petitions is closed.
