ORDER
The petitioner has filed the present Writ Petition to issue a Writ of Mandamus, to direct the respondent to dispose of the statutory appeal filed by the petitioner dated 27.12.2017 and now pending on the file of the respondent in NK C2 5360/2018 as expeditiously as possible.
2.Mr.C.M.Mari Chelliah Prabhu, learned Additional Government Pleader takes notice for the respondents.
3.By consent, the Writ Petition is taken up for final disposal at the stage of admission itself.
4.According to the petitioner, he preferred an appeal before the respondent on 27.12.2017 challenging the classification of the property comprised in Old Survey No.177/14 (part), New Survey No.476/9 measuring 0.05.05 ares land at Sembanur Village, Kallal Hamlet, Karaikudi Taluk. The respondent served summons dated 09.04.2018 and 26.04.2018 to the petitioner to appear for enquiry on 24.04.2018 and 03.07.2018 respectively. Though the petitioner appeared for enquiry, the appeal is still pending without any progress. W.P.(MD)No.7538 of 2020 5.The learned Additional Government Pleader appearing for the respondent submitted that the respondent has conducted inspection and therefore, seeks four weeks time to conclude the enquiry and pass final orders.
6.Recording the aforesaid submission made by the learned Additional Government Pleader and also considering the limited scope of the prayer sought for in the Writ Petition, this Court, without expressing any opinion with regard to the merits of the matter, directs the respondent / the District Revenue Officer, Sivagangai, to dispose of the appeal filed by the petitioner dated 27.12.2017, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. 7.This Writ Petition is disposed of in the above terms. No costs. Consequently, connected Miscellaneous Petition is closed.
