Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Mandamus directing the 1st respondent to consider petitioner's representation dated 09.02.2024 and consequently accord sanction for prosecution.

ORDER

This Writ Petition has been filed to direct the first respondent to consider the petitioner's representation dated 09.02.2024 and consequently accord sanction for prosecution.

2. The learned counsel appearing for the petitioner would submit that the petitioner's representation dated 09.02.2024 to accord sanction to initiate criminal proceedings against the Deputy Tahsildar, Okkur, Sivagangai District is yet to be considered. Hence, the Writ Petition.

The learned Special Government Pleader appearing for the respondents would submit that considering the petitioner's representation, disciplinary action was already initiated against the officer concerned. However, the concerned officer has discharged his duties in the course of his day to day affairs. Though, initially, the officer concerned refused to issue patta as sought for by the petitioner, subsequently patta was issued. According to him, the allegations of the petitioner are not sufficient to criminally prosecute the officer concerned. He therefore, prayed for dismissal of this Writ Petition.

Upon hearing either sides and perusal of records, this Court finds that the officer concerned is not arrayed as a party before this Court and the petitioner is attempting to get an order behind his back. Grant of sanction for prosecution is a serious affair and this Court finds malafide intention on the part of the petitioner. Hence, this Court is not inclined to entertain this Writ Petition.
