O R D E R

The petitioner herein seeks a direction to the third respondent to survey and fix the boundaries of her property situated in Survey No.107/15 to an extent of 81 cents, at Ayan Punjai, Veppanoothu Village, Usulampatti Taluk, Madurai District, as per the schedule in sale deed, dated 04.05.1965 registered as document No.164/1965, and by considering her representation dated 14.02.2023.

2. According to the petitioner, the subject property was purchased by the petitioner's father-in-law Sokka Dhevar by way of a sale deed dated 04.05.1965, vide registered document No.164/1965. The said Sokka Dhevar died on 12.11.2003, leaving his legal heirs namely, 1.Raman, 2.Iyyer, 3.Natarajan, 4. Permaayi, 5.Loganayagi, 6.Paraman. The patta stands in the name of Sokka Dhevar in Patta No.436. After death of Sokka Dhevar, his 2/6

legal heirs inherited the aforesaid properties. The petitioner is the wife of Natarajan, who is one of the legal heirs of Sokka Dhevar. The petitioner submitted an instant representation dated 14.02.2023 seeking survey of the property. The same has not been considered. Hence, she has come before this Court.

3. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents 1 to 3.

4. Though the fourth respondent has been served and her name has also been printed in the cause list, she has not chosen to appear either in person or through her counsel.

5. The learned counsel appearing for the petitioner submits that the petitioner has not produced acknowledgement for having filed the online application. Hence, her request has not been considered.

6. In view of the same, without expressing any opinion on the merits of the matter, the petitioner is directed to file proper online application and 3/6

produce the acknowledgement before the second respondent within a period of two weeks from the date of receipt of a copy of this order. On submission of online application, the second respondent shall consider the same and pass final orders on its own merits within a period of twelve weeks thereafter, after issuing notice to the petitioner, fourth respondent and neighbouring land owners.

7. Accordingly, this Writ Petition stands disposed of. There shall be no order as to costs.
