This Criminal Original Petition is filed seeking a direction to the respondents not to harass the petitioner under the guise of enquiry on the basis of the complaint given by the third respondent herein.
2. When the matter came up for hearing, the learned counsel for the petitioner would submit that there was a transaction of selling and purchasing of Innova Old car, in respect of which, the balance amount has to be paid by him. Demanding the amount, the third respondent has given a complaint.
3. The learned Additional Public Prosecutor (Crl. Side) would submit that based upon the complaint given by the third respondent https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD) No.6108 of 2021 herein, enquiry was undertaken in C.No.42/2021 and during the course of enquiry, both parties agreed to settle the matter and the petitioner agreed to pay the balance amount within a short time. On that basis, the enquiry was closed on 01.05.2021.
4. Since enquiry itself has been closed, nothing survives for further consideration or direction and therefore, it has become infructuous. Recording the above submission, this Criminal Original Petition stands disposed of.
