O R D E R

This petition has been filed to direct the Principal District and Sessions Court, Theni to consider the surrender and bail application filed by the petitioner in Crime No.775 of 2016 pending on the file of the respondent police on the same day.

2. When the matter is taken up for hearing, the learned counsel for the petitioners seeks permission of this Court to withdraw this petition and he has also made an endorsement to that effect in the bundle as follows:

"Kindly permit to withdraw the Crl.O.P.No.23432 of 2016, with a liberty to file a fresh petition"

3. The said endorsement is recorded. Hence, this Criminal Original Petition is dismissed as withdrawn with liberty to the petitioner to file a fresh petition to work out his remedy in accordance with law.
