PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, 2023, To call for the records in C.C. No. 37 of 2025 on the file of the Judicial Magistrate Court, Devakottai and quash the same as devoid of merits and pass such further or other orders.

ORDER
The present petition has been filed by Accused Nos.1 and 2 in C.C.No. 37 of 2025 on the file of the Judicial Magistrate Court, Devakottai, wherein they are alleged to have been charged with offences under Sections 294(b), 324, and 506(2) of the IPC.
2. A perusal of the charge sheet reveals that the petitioners herein, who are hotel owners, are alleged to have attacked their customer during a quarrel, in which the defacto complainant sustained grievous injuries.
3. According to the learned counsel appearing for the petitioner, the defacto complainant has been set up by another person with whom the petitioners have previous enmity, and therefore, the case is false.
4. Heard the learned Counsels appearing on either side and perused the materials available on record.
5. A perusal of the charge sheet clearly reveals that specific overtact is attributed to the petitioners herein in the occurrence, and that the defacto complainant also sustained injuries.

6. In such circumstances, this Court does not find any legal ground to quash the charge sheet, and there are no merits in the present petition. Accordingly, this Criminal Original Petition stands dismissed. Consequently, the connected miscellaneous petitions are closed. 03.06.2026 NCC : Yes/No Index : Yes/No Internet: Yes/No gvn To:-
