Respondents PRAYER : Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus to direct the respondents 1 and 2 herein to conduct the survey, measure and fix the boundary stones in respect of the petitioner property comprised in S.No.416/3 Vellanoor Village, Pudukottai District on the basis of petitioner's application dated 31.03.2021 within the time prescribed by this Court.

ORDER

This writ petition has been filed for the issue of a writ of mandamus directing the respondents to act upon the application submitted by the petitioner on 31.03.2021, wherein, the petitioner has sought for survey of the subject property and for fixing the boundary stones.

2.The case of the petitioner is that the subject property was assigned in his favour by proceedings dated 17.09.2012. The further case of the petitioner is that the patta was also granted in his favour in Patta No.1267. The petitioner wants to conduct the survey in the subject property and to fix the boundary stones. He submitted an application in this regard before the respondents on https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.8829 of 2021 31.03.2021. Since the same was not acted upon, the present writ petition has been filed before this Court seeking appropriate directions.

3. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents.

4. Taking into consideration the facts and circumstances of the case and the limited relief sought for in this writ petition, there shall be a direction to the respondents to act upon the application/representation submitted by the petitioner on 31.03.2021 and deal with the same on its own merits and in accordance with law and take a decision with regard to the survey of the subject property within four weeks from the date of receipt of a copy of this order.

5. The petitioner is directed to make a fresh representation to the respondents along with all the relevant documents and also a copy of this order.

6. This writ petition is disposed of with the above direction. No costs.
