Order : These petitions coming on for orders upon perusing the petitions filed in support thereof and upon hearing the arguments of MR.A.ROBINSON, Government Advocate (Crl.Side) Advocate for the petitioner in both the petitions, and of MR.P.R.PRITHIVIRAJ, Advocate on behalf of the Respondent in both the petitions, the court made the following order:- This Criminal Miscellaneous Petition has been filed by the Inspector of Police, NIB-CID, Madurai to cancel the bail granted to the respondent/accused in Crl.O.P(MD).No.8240 of 2018, dated 23.05.2018.

2.Heard the learned counsel appearing on either side. https://hcservices.ecourts.gov.in/hcservices/ 3.The respondent is the accused in Crime No.12 of 2018 on the file of the Inspector of Police, NIB-CID,Madurai. The contraband

in question is 204 Kgs of ganja. This is commercial quantity. Bail has been granted on 23.05.2018 in Crl.O.P(MD).No.8240 of 2018, without recording any satisfaction in terms of Section 37 of NDPS Act. Therefore, the bail granted to the petitioner in Crl.O.P(MD). No.8240 of 2018 is illegal and the same stands cancelled. 4.Accordingly, the Criminal Miscellaneous Petition in Crl.M.P(MD).No.4112 of 2018 is allowed. Consequently, the connected Crl.M.P(MD).No.4113 of 2018 is closed.
