PRAYER: Criminal Original Petition is filed under Section 483(i)(b) r/w 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 to set aside the condition No(i) imposed by the learned Principal District and Sessions Judge, Srivilliputhur, Virudhunagar in Crl.M.P.No.842 of 2025, dated 11.03.2025.

O RDER This Petition has been filed to set aside the condition No(i) imposed by the learned Principal District and Sessions Judge, Srivilliputhur, Virudhunagar in Crl.M.P.No.842 of 2025, dated 11.03.2025.

Mr.S.Lingarasu, learned counsel appearing for the petitioner, submits that since the petitioner has been arrayed as A4 and formally arrested on 26.10.2024 and he was released on bail vide order in Crl.M.P.No.842 of 2025, dated 11.03.2025. While granting the bail, the learned Principal District and Sessions Judge, Srivilliputhur, Virudhunagar imposed a condition that the petitioner shall deposit a sum of Rs.4,00,000/- before the learned Judicial Magistrate No.I, Sivakasi in the case in Crime No.292 of 2024 of Sivakasi Town Police Station. He further submits that the petitioner is a coolie worker and breadwinner of his family. Hence, he could not deposit the sum of Rs.4,00,000/- before the learned Judicial Magistrate No.I, Sivakasi. Therefore, he prays to set aside the condition No(i) in Crl.M.P.No.842 of 2025, dated 11.03.2025. 2/4

3. Heard Mr.S.S.Manoj, the learned Government Advocate (Crl.Side) appearing for the State.

4. It is to be noted that the total amount involved in this alleged offence is Rs.12,35,500/- and totally four accused involved in this case. In view of the facts and circumstances of the case, this Court is of the considered view that the condition imposed by the learned Principal District and Sessions Judge, Virudhunagar is reasonable and there is no reason to modify the aforesaid condition. Hence, this Court is not inclined to allow this petition. Therefore, this Criminal Original Petition is dismissed.
