Prayer: This Criminal Original Petition filed under Section 407 Cr.P.C. to withdraw the proceedings in M.C.No. 04 of 2016 pending on the file of the Hon'ble Judicial Magistrate, Ambasamudaram and transfer the same to the Judicial Magistrate Court at Nagercoil. ORDER

This petition has been filed seeking to transfer the proceedings in M.C.No. 04 of 2016 pending on the file of the learned Judicial Magistrate, Ambasamudaram and transfer the same to the Judicial Magistrate Court at Nagercoil.

2. The ground on which this petition has been filed is that the petitioners are the residents of Chennai and they have been dragged to face the proceedings before the learned Judicial Magistrate, Ambasamudram. The further ground that has been raised in the petition is that there is a threat to the petitioners from the family of the respondents.

3. This Court is not convinced with the grounds that has been raised by the petition to seek for transfer. The first petitioner shall appear before the court as and when required .The second and third petitioners can also be represented by a counsel in this case and shall appear as and when their appearance is required by the court below.

4. Since the M.C is of the year 2016, there shall be a direction to the court below to complete the proceedings within a period of three months from the date of receipt of copy of this order

5. The Criminal Original Petition is disposed of with the above directions. Consequently connected miscellaneous petitions are closed.
