The prayer sought for in this writ petition is for a writ of mandamus, directing the respondent to remove the name of nominee from all the petitioner's service related registers including acquittance register, PF, gratuity and other retirement benefits etc. based on representation dated 30.04.2018. 2.Heard Mr.RM.Arun Swaminathan, learned counsel for the petitioner and Mr.D.Sivaraman, learned standing counsel appearing for the respondent.
3.The petitioner is the Conductor at the respondent Corporation and he had already nominated his elder son as the nominee in the service register of the petitioner. However, according to the petitioner, suddenly, without the knowledge of the petitioner and without his consent, the name of his deserted wife has been entered as a nominee for the petitioner. In order to remove the name of the deserted wife, who is, according to the petitioner, has not been living with the petitioner for the past more than 20 years, the petitioner has given representation on 30.04.2018. https://hcservices.ecourts.gov.in/hcservices/
4.The learned counsel for the petitioner would submit that if the said representation given by the petitioner is directed to be considered within a time frame, the petitioner would be satisfied. 5.I have heard Mr.D.Sivaraman, learned counsel appearing for the respondent, who would submit that the said representation of the petitioner dated 30.04.2018 would be considered and necessary steps would be taken as per the wish of the petitioner. 6.In view of the said submissions made by both sides, this writ petition is disposed of with the following direction: "The respondent is directed to consider the representation of the petitioner dated 30.04.2018 with regard to his request for change of nominee in the service register and pass orders thereon on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order."
7.With the above direction, this writ petition is disposed of. No costs.
