This Petition filed Under Section 397 r/w.401 Criminal Procedure Code praying to call for the records of Judicial Magistrate, (Fast Track Court), Pattukkotai in Cr.M.P.No.1706 of 2016 in STC.No.25 of 2016 and set aside the order dated 06.01.2017. ORDER:

This Petition coming on this day and upon perusing the earlier order of this court dated:13.10.2017, and the letter received from the Chief Judicial Magistrate, Thanjavur at Kumbakonam, in D.No.1817, dated 18.04.2018 seeking for Extension of time and upon hearing the arguments of Mr.S.Deenadhayalan, Counsel for the Petitioner, and M/S.S.Bharathi, Counsel for the Respondent, and this Court made the following order:

This Court by an order dated 13.10.2017, directed the trial Court to dispose of the case within a period of two months from the date of receipt of a copy of that order. Thereafter, the Trial Court had sent a letter dated 18.01.2018, for extension of time and the extension of time was granted for a further period of three months. 2.Thereafter the accused, who are advocates, are not cooperating with the trial. Hence, the Trial Court has issued NBW against the accused on 07.03.2018 and the same was recalled on 23.03.2018 and the accused has filed a Transfer O.P in Tr.Cr.M.P.No.1113 of 2018 and Cr.M.P.No.1114 of 2018, before the District Court. It is stated that no stay is granted so far. In the meanwhile, again the Trial Court had sent a letter dated 12.04.2018, for extension of time.

4.The Registry is directed to send a copy of the order to the Chief Judicial Magistrate, Thanjavur at Kumbakonam and The Judicial Magistrate, Fast Track Court, Pattukottai.
