PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned "Refusal Check Slip" under RFL/Panagudi/13/2025 dated 13.03.2025 issued by the respondent and to quash the same and to direct the respondent to register the sale deed dated 13.03.2025, in relation to the lands to an extent of 24.63 cents (0.09.98 Hectares) situated within large extent of 4 Acre 37 Cents, comprised in Survey No.898/1 (887/17A1C as per Sub Division), Levinjipuram Village, Radhapuram Taluk and Tirunelveli District, within a time frame as may be fixed by this Court.

ORDER

The present Writ of Certiorarified Mandamus, to quash the impugned "Refusal Check Slip" under RFL/Panagudi/13/2025 dated 13.03.2025 issued by the respondent and to direct the respondent to register the sale deed dated 13.03.2025.

2.Through the impugned order, the respondents have stated that it is an unapproved layout, therefore, the same cannot be registered. 3.On perusal of the sale deed, especially, the schedule of properties, it is seen that on East, West and North there are only agricultural lands and it is not shown as housing plots. Further, on the Southern side, it is shown as already existing pathway. Therefore, there is no creation of new pathway. This will show that it is not a layout property. Therefore, the refusal slip is incorrect. 4.Hence, the impugned refusal slip is quashed and the respondent is directed to register the sale deed within a period of four weeks from the date of receipt of a copy of this order.

5.With the above observations, this Writ Petition is allowed. There shall be no order as to costs.
