Bus Stand in petitioner's favour by considering the petitioner's bid within a time frame fixed by this Court.

ORDER

The petitioner is before this Court seeking a direction to the respondent to allot Shop No. 6 situated in the Kodai Road Bus Stand.

2. The petitioner claims that she has been in possession of the said shop as a lessee since 1997. Upon expiry of the lease period, the respondents issued a tender notification inviting bids for allotment of the said shop along with other shops. The petitioner also participated in the tender process and submitted her bid for Shop No. 6.

3. There were four bidders in total, including the petitioner. The petitioner had quoted a monthly rent of Rs.4,800/-, which was the lowest bid, whereas one P. Muthualagu had quoted Rs.11,100/- per month, 2/7

which was the highest bid. The highest bidder was called upon to pay the annual rental amount within 24 hours in terms of Tender Condition No.

6. Since the said bidder failed to remit the annual rental amount within the stipulated time, his bid was cancelled and the Earnest Money Deposit was forfeited. Consequently, the respondents decided to cancel the tender process and issue a fresh auction notification.

4. By order dated 08.04.2025, this Court directed the parties to maintain status quo. Pursuant to the said order, the petitioner continues to remain in possession of the shop.

5. In view of the above, the writ petition is disposed of by reserving liberty to the respondents to issue a fresh auction notification inviting bids for allotment of the shops.

6. In the event the petitioner participates in the fresh auction process, her bid shall be considered in accordance with the terms and conditions of the auction notification. Until completion of the fresh auction process, the petitioner shall be permitted to continue in 3/7

possession of the shop, subject to payment of any arrears of rent and continued payment of monthly rent as and when it falls due. It is made clear that the respondents shall follow due process of law while conducting the re-auction of the shops.

7. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
